The Department of Veterans Affairs (VA) recently revealed an alarming oversight: approximately 90,000 Vietnam era veterans were not notified about their potential eligibility for benefits related to Agent Orange exposure due to changes in the law. This significant lapse has left many veterans unaware of the benefits they rightfully deserve. Understanding Presumptives for Agent Orange Exposure

To begin, it’s crucial to grasp the concept of legal presumptives, a key element in facilitating successful VA claims for Agent Orange exposure. Essentially, presumptives simplify the process for veterans to prove their exposure and related health conditions.

  • Exposure Presumption: The first type focuses on the presumption of exposure. If a veteran served at certain locations and times recognized by the VA, their exposure to Agent Orange is presumed. This means they no longer need to prove that they were exposed; their service records suffice. 
  • Medical Nexus Presumption: The second type pertains to medical nexus. Typically, to establish a service connection, veterans need to demonstrate a current disability, an in-service event causing the disability, and a medical link between the two. However, if the VA has recognized certain health conditions as linked to Agent Orange, the medical nexus is presumed, significantly easing the burden of proof on the veterans.

Evolution of Presumptives Over Time

The criteria and conditions for these presumptives have evolved considerably:

  • Pre-2015 Standards: Initially, the VA presumed exposure for those with boots on the ground or naval service in Vietnam's inner waterways, service along Korea’s DMZ, or perimeter duties at Thai bases.
  • 2015 Expansion: A notable shift occurred in 2015 with the inclusion of C-123 aircraft personnel. These individuals were presumed exposed if they operated, maintained, or worked on these planes, which were used for spraying Agent Orange. The residual contamination extended this presumption long after the war.
  • 2019 Blue Water Navy Act: This law marked a significant milestone, extending the presumption to veterans serving up to twelve nautical miles off Vietnam's coast. Additionally, it backdated exposure presumption for Korean DMZ veterans from April 1968 to September 1967.
  • 2021 Additions: New conditions like bladder cancer, hypothyroidism, and Parkinsonism (alongside existing conditions like Parkinson's disease) were added to the list of presumptive ailments.
  • 2022 PACT Act: The PACT Act further broadened the scope, including veterans who served in Laos, Cambodia, Guam, and Johnston Atoll. It also introduced new presumptives, namely hypertension and monoclonal gammopathy of undetermined significance (MGUS).

Navigating Claims and Ensuring Eligibility

  • Supplemental Claims: If you were previously denied over a year ago, file a VA Form 20-0995 with new and relevant evidence. Changes in the law that now recognize your condition can be cited as this new evidence.
  • Higher-Level Review: If your denial was within the past year, you can request a higher-level review if you believe the presumptive rules were misapplied. The VA might rectify such errors upon a thorough reassessment.
  • New Claims: For first-time filers, VA Form 21-526EZ is necessary. Submitting proof of your disability alongside evidence of your qualifying service locations and timeframes will strengthen your claim.
